Indian Health Service: Information on Third-Party Collections and Processes to Procure Supplies and Services

What GAO Found

The Indian Health Service’s (IHS) third-party collections—that is, payments for patients’ medical care received from public programs such as Medicaid and Medicare or from private insurers—increased from about $943 million in fiscal year 2015 to about $1.15 billion in fiscal year 2019 at its federal facilities. In fiscal year 2020—which included the beginning of the COVID-19 pandemic—collections decreased by about 4 percent to $1.10 billion, but they rebounded to about $1.26 billion in fiscal year 2021. According to IHS, these collections are increasingly important, as they represent a significant portion of facilities’ health care delivery budgets. As a result, even a modest decline can affect facility operations.

While IHS headquarters conducts some oversight of third-party collections—including reviewing facilities’ biannual data submissions—the agency has delegated much of the responsibility for this oversight to its area offices. Area office officials told GAO they oversee these funds by (1) taking steps to ensure facilities determine and verify whether a patient has or is eligible for insurance from a third-party payer at each patient visit, (2) regularly communicating with and providing training to facility staff, and (3) regularly reviewing facility information, including facilities’ biannual data submissions before they were sent to headquarters. IHS headquarters officials used these data submissions to identify any concerns that need to be addressed by facilities in a corrective action plan—such as a backlog in billing. GAO’s review of the two most recent submissions showed all facilities within the nine area offices submitted these data to headquarters.

When procuring products and services needed for its operations, IHS may use the Buy Indian Act to give priority to Indian-owned and -controlled businesses without using a competitive contracting process. IHS’s use of the Act has increased since fiscal year 2015 but generally comprises less than 5 percent of annual non-pharmaceutical contract obligations. (See figure.) IHS officials described actions they have taken that may have contributed to this increase, including creating lists of known Indian-owned businesses to which IHS staff can refer when searching for a product or service.

Why GAO Did This Study

IHS provides care to American Indians and Alaska Natives (AI/AN) through a system of federally and tribally operated facilities. In addition to receiving appropriated funds, IHS relies on funding from third-party collections to procure services, supplies, and pharmaceuticals needed for its operations. Ensuring AI/ANs have access to quality health care requires IHS to effectively manage its resources such as third-party collections and procurement processes, including those procurements made under the Buy Indian Act.

GAO was asked to review IHS’s oversight of third-party collections and its procurements. Among other things, this report examines recent trends in, and IHS’s processes to oversee, third-party collections and the extent to which IHS uses the Buy Indian Act when procuring services and products, such as medical supplies. GAO reviewed agency documents, including policies, and interviewed IHS officials from headquarters and the nine area offices with two or more federally operated facilities—area offices are responsible for monitoring federally operated facilities’ operations and finances. GAO also reviewed data on third-party collections at IHS federally operated facilities for fiscal years 2015 through 2021 and analyzed contracting data from the Federal Procurement Data System for fiscal years 2015 through 2020, the most recent data available at the time GAO began its review.

  • VA Health Care: Incomplete Information Hinders Usefulness of Market Assessments for VA Facility Realignment

    What GAO Found The Department of Veterans Affairs (VA) conducted assessments of its capacity within 96 markets to deliver health care to veterans through VA providers and, when the Department cannot provide the care needed, through non-VA providers, known as community care. For these assessments, markets are designated geographic areas made up of a set of contiguous counties that contain one or more VA medical centers and associated clinics. For an overview of VA’s approach, see the figure. Overview of Department of Veterans Affairs’ Approach to Its Market Assessments VA officials described the department’s process of developing proposals as iterative in that VA continually reviewed and revised draft proposals throughout the market assessments process. The VA Secretary plans to transmit recommendations to the Asset and Infrastructure Review Commission by March 14, 2022—that is, no later than 6 weeks from the statutory deadline of January 31, 2022. The Commission will then review these recommendations, hold public hearings, and prepare and issue their own recommendations to the President. GAO identified gaps in the data VA compiled and certified for the market assessments that were relevant to determining both the supply of and demand for non-VA care. For example, VA lacked complete data on the extent to which its contractors maintain an adequate number of non-VA providers to ensure veterans have timely access to community care. VA officials told GAO that they determined supply and demand based on the most recently available data at the time of data compilation—December 2018 to November 2020. In addition, while VA officials told GAO the end-of-assessment analyses included updated data on community care, these data did not address the gaps GAO identified. Without such information, VA lacks a full understanding of the extent to which community care is able to supplement VA facility care to meet veterans’ current and future demand. GAO also found that VA’s approach to the market assessments did not include steps to collect information on the quality of VA data compiled from numerous VA data sources or other steps to understand any relevant data limitations. Instead, VA officials leading the market assessments said they relied on VA offices responsible for the databases to ensure the data quality. As a result, VA is unable to communicate to external stakeholders, such as the Asset and Infrastructure Review Commission, all relevant information on the quality of VA data used in market assessments, including any limitations affecting these data and the resulting proposals for realignment. Why GAO Did This Study The VA MISSION Act of 2018 required VA to assess its capacity to deliver health care to veterans. This was done in response to challenges facing the department such as an aging veteran population, antiquated health care infrastructure, and limitations with VA’s capital planning processes. VA officials said these market assessments—conducted at the VA health care market level—will inform the Secretary’s planned recommendations on modernizing and realigning VA health care delivery that the VA MISSION Act requires VA to issue by January 31, 2022. GAO was asked to review VA’s market assessment methodology. This report (1) describes VA’s approach to its market assessments; and (2) identifies limitations in that approach. GAO reviewed VA documents and data used to inform the market assessments and interviewed VA officials responsible for conducting the market assessments.

    The Department of Labor requested reconsideration of a decision which sustained a protest against a contract award for social services. GAO sustained the protest because of: (1) Labor’s agreement with one of two offerers within the competitive range following best and final offers concerning government-furnished property; and (2) a resulting cost analysis which possibly prejudiced the protester. GAO recommended the reopening of negotiations with a clear statement of the requirements and termination of the awardee’s contract should the protester’s proposal prove more advantageous. Labor requested reconsideration on the grounds that the protester was not prejudiced by the negotiations with the awardee and contended that the recommended corrective action was inappropriate. GAO found that it was not clear that the changes effected by the negotiations were not prejudicial to the protester because a reallocation of savings which followed best and final offers allowed the awardee to reduce its bid. Furthermore, GAO found that Labor presented no convincing evidence that GAO erred in concluding that the protester might have successfully competed had it received the same access to government-owned property which had been developed by the awardee. Therefore, GAO held that the negotiations after best and final offers resulted in a substantial change in contract requirements which possibly prejudiced the protester. Accordingly, GAO affirmed its prior decision; however, since less than 3 months’ performance remained on the contract, and Labor had decided not to exercise the contract’s option but to issue a new solicitation, GAO had no objection to Labor’s not reopening negotiations on the original contract.

  • Critical Infrastructure Protection: Agencies Need to Assess Adoption of Cybersecurity Guidance

    What GAO Found Federal agencies with a lead role to assist and protect one or more of the nation’s 16 critical infrastructures are referred to as sector risk management agencies (SRMAs). The SRMAs for three of the 16 have determined the extent of their sector’s adoption of the National Institute of Standards and Technology’s (NIST) Framework for Improving Critical Infrastructure Cybersecurity (framework). In doing so, lead agencies took actions such as developing sector surveys and conducting technical assessments mapped to framework elements. SRMAs for four sectors have taken initial steps to determine adoption (see figure). However, lead agencies for nine sectors have not taken steps to determine framework adoption. Status of Framework Adoption by Critical Infrastructure Sector Regarding improvements resulting from sector-wide use, five of the 16 critical infrastructure sectors’ SRMAs have identified or taken steps to identify sector-wide improvements from framework use, as GAO previously recommended. For example, the Environmental Protection Agency identified an approximately 32 percent overall increase in the use of framework-recommended cybersecurity controls among the 146 water utilities that requested and received voluntary technical assessments. In addition, SRMAs for the government facilities sector identified improvements in cybersecurity performance metrics and information standardization resulting from federal agencies’ use of the framework. However, SRMAs for the remaining 11 sectors did not identify improvements and were not able to describe potential successes from their sectors’ use of the framework. SRMAs reported various challenges to determining framework adoption and identifying sector-wide improvements. For example, they noted limitations in knowledge and skills to implement the framework, the voluntary nature of the framework, other priorities that may take precedence over framework adoption, and the difficulty of developing precise measurements of improvement were challenges to measuring adoption and improvements. To help address challenges, NIST launched an information security measurement program in September 2020 and the Department of Homeland Security has an information network that enables sectors to share best practices. Implementing GAO’s prior recommendations on framework adoption and improvements are key factors that can lead to sectors pursuing further protection against cybersecurity threats. Why GAO Did This Study The nation’s 16 critical infrastructure sectors provide essential services such as banking, electricity, and gas and oil distribution. However, increasing cyber threats—like the May 2021 ransomware cyberattack on an American oil pipeline system that led to regional gas shortages—represent a significant national security challenge. To better protect against cyber threats, NIST facilitated, as required by federal law, the development of a voluntary framework of cybersecurity standards and procedures for sectors to use. The Cybersecurity Enhancement Act of 2014 included provisions for GAO to review aspects of the framework. GAO’s report addresses the extent to which SRMAs have (1) determined framework adoption by entities within their respective sectors and (2) identified improvements resulting from sector-wide use. GAO analyzed documentation, such as requests for information, polls, and survey instruments. It also conducted interviews with agency officials from each SRMA and NIST.

    What GAO Found In recent years, the Department of Veterans Affairs (VA) has significantly expanded the Veterans Benefits Administration’s (VBA) use of contractors to perform disability medical exams instead of relying on Veterans Health Administration (VHA) medical centers. According to VBA officials, VA’s policy is to continue using contractors for most exams. GAO previously identified sound practices agencies can use to plan for significant programmatic changes. However, VBA has not applied several of these practices to its plans for allocating workloads among its contractors and VHA medical centers. For example, VBA has not assessed potential risks to capacity and exam quality in allocating the bulk of exams to contractors. Employing such practices could help VBA identify potential risks stemming from this long-term program change and better plan for addressing future workload needs. Percent of Disability Exams Performed by VBA Contractors and by VHA Medical Centers, Fiscal Years 2017-2021 Over time, VA has also permitted contractors to complete exams for more complex disability claims—such as Gulf War Illness—according to VBA officials, but VBA does not conduct targeted reviews specifically to assess the quality of the exam reports completed for these exams. VBA data show that exam reports for selected complex claims were returned to examiners for correction or clarification at about twice the rate that exam reports were returned overall. Disability medical examiners told GAO that these types of exams can be challenging. Without specifically assessing how well contractors perform on exams for complex claims, VBA is missing an opportunity to identify actions that could help ensure veterans receive high quality exams and that exam reports are completed correctly. Why GAO Did This Study This testimony summarizes the information contained in GAO’s March 2021 report, entitled VA Disability Exams: Better Planning Needed as Use of Contracted Examiners Continues to Grow (GAO-21-444T).
